This book is designed to assist pharmacists, pharmacy students, attorneys, and other interested parties in understanding the laws and rules that affect the practice of pharmacy in Texas. Sections A and B also discuss some of the federal laws that impact the practice of pharmacy in Texas. Our goal was to create a practical book that can be used both in the classroom, pharmacists, and attorneys who have questions concerning the practice of pharmacy in Texas. The book also serves as an excellent study guide for those preparing to take the Multistate Pharmacy Jurisprudence ExamTM for Texas.
Where possible, we have attempted to bring together sections of the Board of Pharmacy rules with the relevant portions of the statute to which they apply. We believe that this makes it easier to understand the law on a given subject without having to flip back and forth between the statute and rules.
While many provisions in the book are taken verbatim from the applicable state or rule, we have also taken the liberty to delete, modify, and/or edit certain sections to make the information clear to the reader. Because of this, the reader should not rely upon the language in this book as the official statutory or rule language and should consult official publications for the definitive and current language of a particular statute or rule. In addition, while every attempt is made to make this material as accurate as possible, the information herein should not be constructed as legal advice. The reader is encouraged to consult a qualified attorney for all legal advice.
About the Authors
Fred Brinkley, Jr., R.Ph., M.B.A. 1969 to 1979 – Held joint appointment as Director of Public Affairs of the Texas Pharmacy Association; Assistant Dean of the University of Texas College of Pharmacy & Director of the National Drug Abuse Education Training Center in San Antonio, Texas. 1972 to 1976 – Director, Iowa Drug Abuse Authority. 1976 to 1997 – Executive Director, Texas State Board of Pharmacy. 1997 to 2009 – Vice President of Professional Affairs, Merck-Medco Managed Care, L.L.C. 1990 to Present – Lecturer and teaches the Pharmacy Law Course at University of Texas at Austin.
Gary G. Cacciatore, Pharm.D., J.D. 1988 – Received Doctor of Pharmacy degree from University of Florida College of Pharmacy. 1994 – Received Doctor of Jurisprudence degree from the University of Houston Law Center. 1997 to Present – Director of Regulatory Affairs for Cardinal Health, Inc. and is an Adjunct Professor at the University of Houston Law Center.

Advance purchase of the book either through an institution not TPA or re-use of a textbook obtained by other means does not entitle the registrant to a refund of the purchasing price. If the registrant has already gained access to the textbook they may choose to donate their free copy included with their registration back to TPA for distribution to special case needs.

Eligibility
To be eligible to be licensed as a pharmacist in Texas, an individual must:
- Be at least 18 years of age;
- Have obtained a B.S. in Pharmacy or a Pharm.D. degree from a Board approved, ACPE accredited college of pharmacy program, or have graduated from a college of pharmacy outside the U.S. and have obtained a full certification from the Foreign Pharmacy Graduate Equivalency Committee (FPGEC);
- Take and pass the NAPLEX and Texas Pharmacy Jurisprudence examination; and
- Complete 1500 hours of Board approved internship.
Examination Requirements
In order for an applicant to be licensed in Texas by examination, you must register and pass the North American Pharmacist Examination (NAPLEX) and the Texas Pharmacy Jurisprudence Examination, more commonly known as the Multistate Pharmacy Jurisprudence Examination (MPJE). These examinations are administered by the National Association of Board’s of Pharmacy (NABP).
The two examinations are scored independently. If the applicant fails one exam and passes the other, the applicant must contact the Board office and pay the necessary fees by the deadlines in order to retake any exam.

The Texas application, the NAPLEX registration form, and the MPJE registration form, will suffice for one administration of the Texas Pharmacy Jurisprudence and NAPLEX examinations. Please allow 6 weeks for processing of your application and registration forms. After the Board processes your application and forwards this information to NABP, you will receive Authorization to Test (ATT). The ATT will be issued and mailed to you by The Chauncey Group International, contracted by NABP. The ATT will contain the dates you will be eligible to take the MPJE and NAPLEX, as well as other information. Please refer to the NAPLEX/MPJE Registration Bulletin for additional important information.
